Digital Product Creators CUSTOM SALES PAGE TERMS AND CONDITIONS

These Custom Sales Page Terms and Conditions (“Terms”) govern the purchase, design, development, hosting, access, and use of Custom Sales Page services provided by Digital Product Creators (“DPC,” “we,” “us,” or “our”).

By purchasing the Custom Sales Page service, submitting payment, providing project materials, accepting the applicable Sales Funnel Design Agreement, or authorizing Digital Product Creators to begin work, the purchaser (“Client,” “you,” or “your”) acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.

1. SCOPE OF SERVICES

Digital Product Creators will design and develop one (1) Custom Sales Page based on the Client’s purchased package and the information, branding, product details, images, content, and other materials provided by the Client.

The Custom Sales Page service may include:

• One (1) customized sales page
• Design and customization based on the Client’s branding, product, or service
• Integration of applicable merchant or payment account information
• Applicable software and tools necessary to operate the page within the DPC Marketing System
• Training and support as included in the purchased package
• Additional features or supporting pages specifically identified as part of the purchased service

Any service, page, integration, customization, redesign, or feature not expressly included in the purchased package is outside the original scope of services and may require additional fees.

2. PAYMENT TERMS

Full payment is required before Digital Product Creators begins any design, development, customization, setup, integration, or other work related to the Client’s Custom Sales Page.

Upon receipt of payment, Digital Product Creators may immediately begin allocating design personnel, development resources, software, systems, administrative support, and technical resources to the Client’s project.

3. ALL SALES ARE FINAL – NO REFUNDS

ALL PAYMENTS FOR CUSTOM SALES PAGE SERVICES ARE FINAL AND NON-REFUNDABLE.

Due to the customized nature of the services provided and the immediate allocation of design, development, administrative, software, and technical resources following purchase, Digital Product Creators does not provide refunds, credits, exchanges, or prorated reimbursements for Custom Sales Page services.

No refund will be issued for reasons including, but not limited to:

• Change of mind after purchase
• Failure to use, launch, market, or monetize the Custom Sales Page
• Failure to provide requested information, materials, or credentials
• Failure to respond to the DPC design, development, or support team
• Failure to review or approve drafts
• Delays caused by the Client
• Personal, financial, employment, medical, or business circumstances
• Dissatisfaction based on personal preference after the agreed scope and applicable revisions have been completed
• Failure to generate expected sales, leads, customers, revenue, conversions, or other business results
• Cancellation or termination of the Client’s DPC Marketing System subscription
• Technical issues caused by the Client’s device, internet connection, browser, domain provider, payment processor, merchant account, third-party software, or other services outside the reasonable control of Digital Product Creators

Failure to access, use, launch, or monetize the Custom Sales Page does not create a right to a refund.

4. CLIENT RESPONSIBILITIES

The Client is responsible for providing all information, materials, and access reasonably required for Digital Product Creators to complete the Custom Sales Page.

This may include, but is not limited to:

• Business and contact information
• Product or service information
• Product descriptions and pricing
• Branding, logos, colors, images, and graphics
• Testimonials
• Videos or other media
• Payment or merchant account information
• Domain information
• Required integrations or account credentials
• Any other materials reasonably requested by the DPC design or development team

The Client is responsible for ensuring that all information provided is accurate and complete.

The Client represents that they own or have obtained all necessary rights, licenses, permissions, and authorizations to use any logos, trademarks, photographs, videos, testimonials, written content, graphics, or other materials submitted to Digital Product Creators.

Failure to provide requested information or materials in a timely manner may delay the project and does not create a right to a refund.

5. DESIGN, REVISIONS, AND FINAL APPROVAL

Digital Product Creators will provide the design and revision services included in the Client’s applicable Sales Funnel Design Agreement or purchased package.

The Client is responsible for reviewing drafts and providing clear and complete revision requests within the timeframe communicated by the DPC design team.

Revision requests must remain within the original agreed scope of the project.

Once the Client provides final approval, the Custom Sales Page will be considered completed and accepted.

Any additional revisions, redesigns, additional pages, additional products, substantial content changes, or other services requested after final approval or outside the original scope may require an additional agreement and additional payment.

6. PROJECT TIMELINE

Any estimated project completion timeframe begins after Digital Product Creators has received all required information, content, materials, credentials, and instructions necessary to begin the project.

Project timelines are estimates and may be extended due to circumstances including:

• Delayed Client responses
• Missing or incomplete materials
• Revision requests
• Changes requested by the Client
• Third-party technical issues
• Domain or payment processor issues
• Circumstances reasonably outside Digital Product Creators’ control

Delays caused by the Client or third-party providers do not create a right to a refund.

7. DPC MARKETING SYSTEM SUBSCRIPTION AND CUSTOM SALES PAGE ACCESS

The Client acknowledges and agrees that the Custom Sales Page is created, hosted, operated, and maintained within the DPC Marketing System and requires an active applicable DPC Marketing System subscription to remain active and accessible.

The Custom Sales Page is not an independently hosted website or page unless Digital Product Creators expressly agrees otherwise in writing.

If the Client cancels or terminates the applicable DPC Marketing System subscription, the Custom Sales Page hosted within the DPC Marketing System will be deactivated, and the Client will lose access to the Custom Sales Page and its associated features, tools, funnels, pages, templates, automations, files, and assets within the platform.

The Custom Sales Page cannot remain active or continue operating independently within the DPC Marketing System after the applicable subscription has been canceled or terminated.

Cancellation or termination of the DPC Marketing System subscription does not cancel, reverse, or create any right to a refund, credit, exchange, or prorated reimbursement of the Custom Sales Page design fee or any other fees previously paid.

8. CANCELLATION, ACCESS REVOCATION, AND DATA DELETION

Upon cancellation or termination of the applicable DPC Marketing System subscription, access to the Custom Sales Page and applicable DPC Marketing System software, tools, websites, funnels, pages, templates, automations, trainings, features, and related services will be revoked in accordance with DPC’s applicable cancellation policies.

Upon cancellation or termination, data associated with the Client’s account, including websites, Custom Sales Pages, funnels, pages, files, content, configurations, and other data stored within the DPC Marketing System, is subject to permanent deletion.

Once deleted, such data cannot be recovered, restored, or retrieved. Digital Product Creators has no obligation to retain, archive, or provide copies of data following cancellation or termination.

The Client is responsible for retaining copies of any original content, images, documents, or other materials provided to Digital Product Creators before submitting a cancellation request.

Cancellation does not entitle the Client to a refund of any Custom Sales Page fees or other fees previously paid.

9. NON-TRANSFERABILITY AND NO DATA PORTABILITY

Custom Sales Pages and associated funnels, websites, templates, workflows, configurations, automations, and other assets created, hosted, or managed within the DPC Marketing System are non-transferable.

The Client may not assign, sell, sublicense, export, migrate, transfer, or authorize any third-party agency, developer, hosting provider, service provider, or other third party to access, duplicate, recreate, take over, or operate any portion of the DPC Marketing System or its proprietary assets except as expressly authorized by Digital Product Creators in writing.

Digital Product Creators does not provide migrations, exports, transfers, data portability, or handoffs of DPC Marketing System assets to third-party platforms, agencies, developers, or hosting providers.

Cancellation or termination of the DPC Marketing System subscription does not create a right to receive a downloadable, transferable, exported, migrated, or independently hosted copy of the Custom Sales Page.

10. THIRD-PARTY SERVICES AND INTEGRATIONS

The Custom Sales Page may use or integrate with third-party services, including payment processors, merchant accounts, domain providers, email providers, applications, or other software and services.

Digital Product Creators does not control third-party providers and is not responsible for their service interruptions, account restrictions, suspensions, transaction holds, technical failures, pricing changes, policy changes, account approvals or rejections, or other actions outside DPC’s reasonable control.

The Client is responsible for maintaining all third-party accounts, subscriptions, permissions, and services necessary for the operation of their Custom Sales Page.

Issues caused by third-party services do not create a right to a refund from Digital Product Creators.

11. INTELLECTUAL PROPERTY AND CLIENT MATERIALS

The Client retains responsibility for the original content and materials they provide to Digital Product Creators.

The Client represents and warrants that they have all necessary ownership rights, licenses, permissions, and authorizations required to use the content and materials submitted for inclusion on the Custom Sales Page.

Digital Product Creators retains all applicable ownership rights and interests in its proprietary systems, software, templates, processes, methodologies, technology, tools, designs, configurations, and other intellectual property.

Purchase of a Custom Sales Page does not transfer ownership of the underlying DPC Marketing System, software, technology, proprietary templates, tools, systems, or other DPC intellectual property to the Client.

12. NO GUARANTEE OF RESULTS

Digital Product Creators does not guarantee that the Custom Sales Page will produce any specific financial, marketing, or business result.

Digital Product Creators makes no guarantee regarding:

• Sales
• Revenue
• Income
• Profit
• Leads
• Customers
• Conversions
• Website traffic
• Audience growth
• Return on investment
• Any other specific business outcome

Results vary and depend on numerous factors outside Digital Product Creators’ control, including the Client’s product or service, offer, pricing, marketing, advertising, audience, traffic, implementation, experience, effort, consistency, and market conditions.

Any testimonials, examples, case studies, income results, or previous Client results are provided for illustrative or educational purposes only and should not be interpreted as a promise or guarantee of future results.

13. SUPPORT AND ACCESS ISSUES

If the Client experiences difficulty accessing the DPC Marketing System, Custom Sales Page, trainings, community portal, or related services, the Client is responsible for promptly contacting Digital Product Creators for assistance.

Failure to contact support, failure to request assistance, or failure to utilize available support does not relieve the Client of payment obligations and does not create a right to a refund.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Digital Product Creators and its owners, officers, directors, employees, contractors, designers, developers, agents, vendors, suppliers, and affiliates shall not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising out of or related to the purchase, use, inability to use, suspension, cancellation, or termination of the Custom Sales Page or associated services.

This includes, without limitation, loss of revenue, profits, income, sales, leads, customers, data, business opportunities, or anticipated business results.

Nothing in these Terms excludes or limits liability to the extent such liability cannot lawfully be excluded or limited.

15. TERMINATION OF SERVICES

Digital Product Creators reserves the right to suspend or terminate services if the Client materially violates these Terms, fails to satisfy applicable payment obligations, misuses DPC systems or services, engages in unlawful activity through DPC services, or otherwise violates applicable DPC policies.

Termination of services does not create a right to a refund for fees already paid or services already rendered.

16. RELATIONSHIP TO OTHER DPC AGREEMENTS

These Custom Sales Page Terms and Conditions should be read together with the applicable Sales Funnel Design Agreement and any applicable DPC Marketing System Terms and Conditions accepted by the Client.

By purchasing and using the Custom Sales Page service, the Client agrees to comply with all applicable DPC agreements and policies.

Where a separate written agreement contains project-specific terms, those project-specific terms will apply to that service to the extent stated in the applicable agreement.

17. CHANGES TO THESE TERMS

Digital Product Creators reserves the right to update or modify these Terms and Conditions from time to time, subject to applicable law.

The version of these Terms applicable to a Client’s purchase will be determined in accordance with the effective date and applicable law.

18. ACCEPTANCE OF TERMS

By purchasing the Custom Sales Page service, submitting payment, accepting the applicable agreement, submitting project materials, or authorizing Digital Product Creators to begin services, the Client acknowledges and agrees that:

• The Client has read and understood these Terms and Conditions.

• All payments for the Custom Sales Page service are final and non-refundable.
• The Client understands the scope and limitations of the purchased service.
• The Client is responsible for providing all required materials and information necessary to complete the project.
• Additional services or work outside the agreed scope may require additional payment.
• The Custom Sales Page is hosted within the DPC Marketing System and requires an active applicable DPC Marketing System subscription to remain active and accessible.
• If the applicable DPC Marketing System subscription is canceled or terminated, the Custom Sales Page will be deactivated and the Client’s access will be revoked.
• Cancellation or termination of the DPC Marketing System subscription does not entitle the Client to a refund of the Custom Sales Page fee or any other fees previously paid.
• Applicable data and assets may be permanently deleted following cancellation or termination in accordance with DPC policies.
• DPC Marketing System assets are non-transferable and are not provided for migration, export, or handoff to third-party platforms or agencies.
• Digital Product Creators does not guarantee sales, income, revenue, leads, conversions, profits, or other business results.

BY COMPLETING THE PURCHASE, SUBMITTING PAYMENT, OR AUTHORIZING DIGITAL PRODUCT CREATORS TO BEGIN SERVICES, THE CLIENT ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE CUSTOM SALES PAGE TERMS AND CONDITIONS.
